B.K.GUPTA... (ADVISOR)     18 June 2012

UPON hearing counsel the Court made the following
                                 O R D E R

Interlocutory      applications     for    permission     to   file

     special leave petitions are granted.

Heard    learned    senior   counsel      and   learned   counsel

     appearing for the petitioners.

Issue notice to the respondents. Dasti is permitted.

Mr.     Surya     Kant,   learned    counsel,      appears     for

Rajasthan Public Service Commission and accepts notice.

Petitioners will serve the other respondents.

All the special leave petitions be placed in the

     third week of July, 2012

Some    of    the     learned       counsel     for    the    petitioners

pointed    out    that    there      are      serious     deficiencies        in    the

examination      which    was     conducted       by      the   Rajasthan     Public

Service Commission for the Rajasthan Judicial Service. It

appears    that    the     High      Court     has     tried     to    find       out   a

via media, but prima facie we feel that such an exercise was

not permissible considering the serious deficiencies which

were found in the examination.                    Mr. Surya Kant, learned

counsel,    seeks       time    to     take    instructions.           He   may    file

     counter affidavit in the meanwhile.

The    subsequent       main     examination          will    not   proceed

until    further       orders    are     passed      on   these    special        leave

     petitions.
