right on property by grandchild


Dear Sir,

 

My Grandfather has some agricultural land which he has purchased.

he had 5 daughters and 3 childrens and all of them having atleast 2+ childrens

My Grandfateher was expired when I was 18 years (after 1995 ) and  my

mother  and her sisters has given her  Relinquishment of rights ( in Marathi " hakka sod patra" ) to my uncle.

now on  7/12 only my three uncles have their names.

 

Do I claim for my any right on My grandfather's Property. There is no Will from my Grand father.

if  yes ..How much land I will receive if my  grandfather had 8 acres of land

Dear Navnath,

Since it was your grand father's self-acquired property, and since he did not leave any WILL, upon his death, the property will go by way of inheritance equally amongst all his legal heirs i.e. your uncles, your mother and aunts, besides your grand mother.

If your mother and aunt(s) have given a registered relinquishment deed, then your mother and aunt(s) cannot claim anything from the property.  You, being the grand child of your grand father has also no right to claim any share in the said property.

if My mother wants to revoke or  chage her " hakka sod patra" and claim on that land, are then there is any chances for this ..

 

By what other means I or my mother can claim on that Land ??

No your mother can not revoke the relinquishment deed now , it could only be revoked if it was executed by fraud and when it has been executed in 1995 now it can not be revoked
