Responsibility of Municipal Corporation

A flat was purchased 5 yrs ago in the second floor building which had been sanctioned building plan for a 4 storeyed building by the local Municipal Corporation.                                                                                                                The owner of the building did not raise any further floor after the second floor where our flat was located.The owner also did not do any treatment for the roof like proper sloping ,its floor reinforcement and surrounding guard wall as a result of which the rain water fell all over the edges of the roof and also seeped through the roof to the ceiling and walls of the flat.                                                                                                                                                This resulted into breaking of ceiling structure , beams ,rotting of wooden windows and extreme dampness of interior walls creating health hazard. As the corporation had sanctioned the building plan for a 4 storied building it is responsible for enforcing that incase of incomplete construction the owner should once again seek fresh sanction for the incomplete building so that the basics of structural safety of the new plan can be examined and that the basic laws of civil engineering are followed for structural safety.                                                                              The owner should be penalised for failing to seek fresh sanction with new revised plan under the building laws.What steps can be taken to impel the municipal corporation to act against the owner and also rectify the defects of construction.                                                                                         Which provisions of the municipal Act can be relevant in this regard.
