resoring a petition

Dear Sir/Madam,

In order to restore the petition which was dismissed by honourable small causes court sometime ago (~3 months) do we need to send notices again to all the respondents of the petition which was dismissed? Some respondents were ex-parte.  What is the procedure?

If some had already been proceeded ex-parte then no need to send them notices of any subsequent application as you are moving in the given facts.

Dear Mr. Makaad,

As per the lawyer the court has asked all the parties/their legal reps to be present for deciding on the restoration application. As per lawyer it is most likely going to be dismissed. He thinks high court appeal would be more appropriate.
