Resigned after getting last salary

Respected Sir/Ma'am,

One staff, from my company resigned just after getting his last salary. He was on leave from 15 days. Now he sent his resignation letter. How we can move legally to ask one month salary as non-notice period resignation and is it compulsory to mention this term in appointment letter to move legal steps.
