Resignation with an immediate effect

One of our employee wants to resign on an immediate effect, but there is a rule in our company, where she has to serve a notice of one month, we asked her to serve a notice so that we can take the handover from her as she is working here since 5.6years. She is not ready to serve a notice. Last day suddenly she fall sick, we had to admit her in the hospital, when we called her parents, they said company is responsible for her bad health and company has to look after her. Now in this situation we can neither release her nor we can ask her to serve a notice. Can anybody suggest me what to do in this scenerio.

You can deduct one month/ 15 days salary whatever rules apply in your case from the last salary of the employee. Regarding handover of all the charges and assets, she is legally bound to do so. If she is in charge of any assets or funds or the company, then you can legally enforce her to handover the same to her successor or any person to whom you employee in spot of her.
