Resignation period for government to government switching

Sir,

 I need Help on  Resignation Notice period  .

 

I am working  in The New India Assurance Co. Ltd  ( P.S.U.) and now i have been  selected in the State government . So I have Resigned on the date 09/05/2014 and request department to relieve me on or before 30/05/2014 so i Can Join the State Department  in the 30 days period of Joining period . In appointment and Service bond there is no information available on Notice period (duration ). Now My company (New India ) says that period must be 90 days and they are asking to deposit  salary for  68 days ( for short period of   notice) .

 

from some where I get to know that there is some Judgement or office memorandum on wave off of the 90 days notice period , if employee is going from  one government department to  other government department .

 

Please help me in this regard , if some one have information or circular or judgement copy in this regard .

Shifting from a PSU to a State Government job is not strictly Government to Government transfer. In any case both PSU's and Government have a rule that one has to apply through proper channel. Or alternatively the Department to which one is going to, will ask for an NOC from the parent Department. Did you apply through proper channel? If so the PSU should not insist on the notice period or the other organisation will honor the requirement. In any case you have no time to legally fight for your case. You can first pay the amount which the PSU is asking and then fight for refund of the amount.
