Repudiation of insurance claim

Dear Members,

"A" is the registered owner of a car. He took insurance policy during his life time. On demise of "A", vehicle was transferred in the name of son "B" and the same was duly intimated to the insurer.

Recently, car met with an accident and damaged. "B" sought for insurance claim. But insurance company repudiated the claim that the registered owner differs and policy stands in the name of previous owner.

1. Whether Insurance Company can absolve its liability in the given facts of the case?

2.  Whether B has any remedy?

Pls answer my queries.

Yes B can approach District Consumer Forum and claim compensation.As soon as vehicle is transferred from one person to another person its all benefit including policy shall also be transferred to the new owner.policy will not lapse even if the intimation as required u/s 103 of the Act is not given to the insurance company.It is deficiency of services on part of the company.
