Rent Agreement after 18 year

Mere ghar me he 1 shop hai, jo mere father sahab ne 18 saal phle kiraye pr diya tha.
USS samay 11 mahine ka agreement bnaya tha, uske bad koi bhi agreement nahi bnaya hai.


18 saal ke bad, hamne pichle saal, usse naya agreement sign krva liya hai, usme hamne dukan kabhi bhi khali krvana ki condition bhi rkhi hai, aur usne sing bhi kiya agreement, dukandar ka photo bhi click kr liya hai mene agreement sign krte hue.


Me yeh zanana chata hu, ke age hum usse dukan khali krvana cheye to, koi pareshani to nahi aegi na?? Aur aegi to kya kya aegi??

Me pune me job krta hu, mene father shaab retire ho chuka hai aur mummy house wife hai.

Father ko dukan kholne hai, krke uses dukan khali krva skte hai kya.

Yes, you can vacate your tenant's shop without any hassle but not by the condition that you have stated in your rent agreement i.e. 'Tenant has to vacate the house as and when he asked to do so.' 

There are three points that are stated in law which a owner can use to vacate his property rented to a tenant, those are:

1. Personal necessity i.e. property required for personal use

2. Subletting i.e. property to be rented to someone else

3. Non- payment of rent i.e. payment has not been paid more than 6 months

As you said that your father have to use the property this means that you have to use for your personal benefit and this reason can be covered under Point 1 stated above. 

For doing so you have to approach the civil court which has jurisdiction over this matter and have to file a eviction petition to the attendant.
