Remedy for Drawee is the holder in due course bank lost the cheque

The Payee submitted a cheque for enchashment. The Drawee bank sent the cheque to lower Branch we presuming it to be holder in due course. The cheque being dishonoured, while being return to bank by branch was lost in way.
What Legal recourse/remedy does the Payee have for the cheque and also for damages.
( Note- Does section 77 of Negotiable instruments act have any role ) ?
