Release deed

sir,

I have to do a deal with my neice.  My mother given equal share to a residential property to me and my niece  through will which she regisitered before her demise.  i have to pay her share and transfer the property to my name.  Is it a release deed to be done or sale deed.  what will be the cost for paper for documentation and stamp duty.  the property is in trichy, tamilnadu.

You/your niece can execute a release deed in favour of another person and the stamp duty has to be paid @7% on the consideration or Market Value of the property whichever is higher.

Even a sale deed is no bar.  Depending on the costs involved you may decide on such valid transfer/sale deed.

on lok adalat we got judgeemet that, i have to pay the fifty percent share of the property and to transfer to my name. then only i can sale the property. the property is also in hrnc litigation.  it cannot be registered in regirster office.  if we make sale deed or release deed we cannot do registration.  because the srirangam temple told that the property is under hindhu  samaya government property. Is the sale deed or release deed with my niece will be valid if done with notary.  because registration is not possible.
