Related to payment of pf and gratuity

I m a lady working in private education institution in uttar pradesh from past 8 years with the salary increased from 45,000/- to 70,000/- . Now I want to quit my job. So can i demand for PROVIDENT FUND? how much bonus can i get? What about GRATUITY??

Quick Summary
If you're leaving a private educational institution in Uttar Pradesh after 8 years of service, you are likely eligible for both Provident Fund (PF) and Gratuity. The Payment of Gratuity Act states that employees with five or more years of continuous service are entitled to gratuity upon resignation. You can also withdraw your accumulated PF amount or transfer it to a new employer, provided your employer deposits it with the EPFO.

Under the Payment of Gratuity Act an employee is entitled to gratuity if he completes at least five years of continuous service. So an employee after resignation is entitled to gratuity provided that he has worked for five years or more.

You are eligible to withdraw your accumulated PF amount too.

You can continue your PF account on joining some other organisation, where credit balance of amount deposited in the account shall be carried forward for accumulation. Otherwise, you may withdraw the amount deposited with interest as applicable at that point of time.

Gratuity is governed by Payment of Gratuity Act, to be paid by employer after completion of 5 years continueous service, demand it if you have become eligible.

Is your organisation covered under the relevant Acts? It depends upon the umber of employees.

Is regular deductions made from your salary towards PF?

Sudhir Kumar, Advocate (Advocate)     14 October 2024

for agreeing or diagreeing with above views, I need to know if the provident fund is deposited in EPFO or not.
