DRI had caught three accused during transportation of 35 gold biscuits and put them in custody, but they had got bail from lower court by taking the advantage of 167(2) . Now DRI has issued a notice u/s 108 of custom act by few queries. Now my question is on physical appearance of them in DRI Office can they take custody again in same case though they are on bail.
please some one help me.

Yes. they have full powers. Function. DRI is the major intelligence agency which enforces the prohibition of the smuggling of items including drugs, gold, diamonds, electronics, foreign currency, and counterfeit Indian currency.

In response to your query,

Yes, they can be held in custody again if the officer in charge thinks it to be necessary for any new development in the case.

Section 108 in the Customs Act, 1962

108. Power to summon persons to give evidence and produce documents.— Any gazetted officer of customs duly empowered by the Central Government in this behalf, shall have power to summon any person whose attendance he considers necessary either to give evidence or to produce a document or any other thing in any inquiry which such officer is making under this Act.
