Regarding property in possession of my fathers brother

Dear experts My grandfather (passed away) had purchased a property on which my Fathers elder brother(passed away now their children�s are living) is living from past 40 years, at that time when property was bought no paper work was done and till now there is no paper work . Except the property is registered on my father brother name in market committee . As now my father is demanding his share from that property they are not ready to give. Here my questions are As the property is registered on the name of my father�s elder brother does this matter Can we claim our share by demanding a legal partition Or should we settle the matter peacefully with relatives help, my fathers sister are with us Kindly help, Thanks in advance Regards karan

First try to find out the status of the property from revenue authorities.

First findout on which name is the property in revenue records , if it is still in your grandfathers name then talk amicably to your cousins with the help of your relatives for partition if they refuses then file the case in the court .
