Yes. Send him a legal Notice first and demand compensation from him within 15 days from receipt of the Notice; failing which, you file a police complaint as well as a private complaint with the Judicial Magistrate / Metropolitn Magistrate. Either police may register the cognizable offence or the Magistrate may dirtect the police u/s 156(3) of Cr.P.C. to register the offence.
