Regarding changing lawyer- civil case

Hi - For one of civil case, we would like to change the lawyer since lawyer is not cooperative. We would need additional time to find a good lawyer in town, can we directly go and submit request to judge on next hearing date to grant additional time for changing lawyer and finding a new lawyer. Please suggest

Yes you can appear before the court in person along with the copy of the letter issued to your lawyer terminating his service and request court to adjourn the matter to some other day to facilitate you to engage the services of a new lawyer.

Take NOC from your previous lawyer and submit it in court on next date and request court to grant some time to you to get new lawyer.

You should / must appear before the court personally on the date fixed and submit for adjourment of the case regarding replacement of your non-cooperative lawyer.

- The court will allow the change of the counsel if there are reasoanble & sufficient grounds 
including but not limited to, non-cooperation, misconduct, sour relationship, no fault on behalf 
of the party or unavailablity.

- A application or oral mentioning can suffice if court deems it fit. 
- A party can appear in-person for this.
- However, the party should ensure that they have disengaged the previous counsel and show 
evidence that they have engaged a new counsel.
- If such route is taken without disenging the previous counsel, then court pass an adverse/un-
-favourable order against such party.
