Refusal of information under rti

I MADE A COMPLAINT AGAINST ONE CHEMIST ON ISSUES LIKE ABSENCE OF PHARMACIST ,ETC TO FDA AND THEN I FILE RTI ASKING FOR ACTION TAKEN ON MY COMPLAINT .FDA REFUSES TO PROVIDE INFORMATION ON THE GROUND THAT THE CHEMIST OBJECTED TO PROVIDE ME INFORMATION U/S 8 AND 11.NOW I WANT TO FILE FIRST APPEAL AGAINST IT.PLEASE PROVIDE ME GROUNDS ON WHICH APPEAL CAN BE MADE

First Appeal under The Right to Information Act, 2005 can be made on following grounds as per section 19 of the Act:

1. Non responsiveness of the PIO within 30 days;

2. Unsatisfactory response from Central or State Public Information Commission as the case may be.

In your case, since there was a clear refusal to provide information, the Central/State Information Commission has the power to impose penalties on such Officer as per s.20 of the Act.

Additionally, for each day of delayed information beyond 30 days, a fine of Rs. 250 is imposed for each day. However, the total fine shall not exceed Rs. 25,000.
