Can a shop owner opt to take from developer a residential flat during Redevelopment in lieu of his shop .
What are the implications of Stamp Duty and GST due this changeover.

Quick Summary
This discussion explores whether a shop owner in a Mumbai co-operative housing society redevelopment can receive a residential flat in exchange for their shop. It touches upon the potential implications for Stamp Duty and GST. The advice given is to confirm this arrangement with the developer and review the agreement terms carefully, as stamp duty varies by state. If it is a redevelopment of combined property i.e., residential and commercial and if the developer accepts the request and has entered into an agreement accordingly but by complying with proper law in this regard, then you can proceed, however you should have asked this question with the developer and not at this place which is an incorrect place.

Terms and conditions of the agreement shall have to be perused for forming proper opinion.

Stamp duty is a State subject which differs from a State to another, contact and consult a local prudent lawyer.
