I have paid Advance of 40K to Marriage Hall in Nov 2020,for the Marriage Date of 24th Feb 2021.Due to some unavoidable Reasons marriage Has been called off.
I have intimated the same by 06th Jan 2021.Marriage Hall owner told that they can't give back the Advance as its stated in their terms and conditions,as whatsoever reason of cancellation advance won't be paid back.
1)Since Its already 18 months over for this,Now Am only trying for Legal Remedies.Still under consumer protection Act 2019 am I eligible to file the case(considering
18 months of Delay),What are the chances of getting Advance Amount back via legal Procedure..
Note: I have sent the Legal Notice to the marriage Hall owner,But they responded stating while booking The Hall itself we told the conditions as Advance Cant be returned incase of any Cancellation.hence they cant give back.
Am looking for Expert Opinion Considering the Above Facts.
