Rcr vs divorce likely to be filed by husband

I am a retired Army officer aged 65 years.

My wife expired last year 28 Oct 2020. Her in laws are now threatening to file for divorce after 4.5 years after leaving her with her mom.

Would it be correct to file a RCR case against Husband
