rcr filled by wife

Wife filled rcr, marriage has not completed 1 year can i file judivial separation based on cruelty and ask the court to dispose rcr based on judicial separation petition. Note the court where rcr is filled is different from the court where i am planning to file judicial separation. I dont want to waste my time in contesting rcr petition as i have made my mind to go for divorce. She and her family are very much cruel in nature. I have replied to her rcr notice i am willing to join you as she dont want to live with my family members in separate house, but she had other demand to which is not acceptable to me. But insist of resolving the matter out side court she approach the court with rcr. She is doing all this intentionally to harass me in court. Please guide me i am planning to file judicial separation which i will ask the court to convert into divorce petition at further stage.
