Rape between Sexual partner?

The UN High Commissioner for Human Rights Navanethem Pillay, recently made a statements in New Delhi on 22-24 March 2009, harping on amending the IPC for enabling the women to file a case against their s*xual partner. Can there be a case of Rape between s*xual partner though they are not married and habitually indulged in S*x?

in my view, 1. allegation of rape only can not be alleged between s*xual parteners. between these relations, there may be other incidental offences alongwith rape.

2.  there may be situations where an act beteen them may technically come under perview of  rape, but those shold remain as academic question only. our courts are already fludded with litigation and most of poor and needy litigants are being deprived of justice due to delay.

I think this not  a fit time to introduce such impractical provisions.

at present IPC regards it as rape to cohabit with wife below 15 yrs. of age. when an adult woman voluntarily have s*x with some one IPC do not term it as rape.
