Qyery regarding kind of writ to be filed

What type of writ is filed in the High court under article 226 of the constitution of India, when both the adults are major and have married according to their own will. But the Family of one of the Parties is harassing them?

What you eat, how you sleep, what you see, what kinds of girl/boy you like and marry as an adult, the kind of people that you associate etc, are all parts of your fundamental human rights, and no one has a right to poke their nose in your private affairs, as pronounce by the Supreme Court in a recent historical and classic Judgment in Right to Privacy case. But invoking writ jurisdiction at this stage will be like a bull in china shop. Remedy at this stage lies in your local area like mediation through family friends and elders and if it fails, file a complaint to the Police as a last resort for harrasment remedy.

Simply filing police complaint seems ideal instead of writ at the first instance

What is the dispute for which you wanted to know the type of writ which can be filed in the High Court or Supreme Court of India?

Who has advised you for filing writ petition wherein you want to invoke extra ordinary jurisdiction for some objection of a family on leading/enjoying your peaceful married life ?

Discuss with a local prudent lawyer with relevant information for proper appreciation of facts, guidance and proceeding.

Hi

In general a Writ is filed at High court only if your fundamental right is violated by state or government agencies

Your grievance is a violation of your right by private persons and hence you should approach the trial courts  or local police station for redressal of grievance.

Hope this information is useful
