Query regarding Pension

Hi people,

I've been running from pillar to post and pole to pole to find the answer to my questions. So far I have just been squindeled.

My Father retired from government service in 1981.He passed away in 1985. My mother did not claim pension as she wanted to keep it as my inhertence.

Recently when I approached a lawyer to to know the process to claim the pension, I was told that money not claimed from the governement for more than 12 years cannot be claimed.

There is law that states that if a person does not claim arrears from the government within 12 years then he waives off the right to claim it.

I need advice on what I can do. Please good advice is seriously needed.

I don't think that there is any limitation period to recover pansion arrears. If there is! it limitation should be counted from the last correspondence between you and authorities. You did not mention about your mother whether she is alive?. If she is alive you can not claim, your mother can. You may win the case only if you have appraoched to authorities for family pension and they asked succession certificate or other proofs from you. Otherwise I think it is a futile effort because your mother already relinquished the claim.

Approach the pension authorities with the documents your father had for receiving pension along with the  death certificate. If your mother is alive you can get the family pension authorised therin for the legal heirs.

Hi ,

I would like to express my gratitude and thanks for your responses. My Mother is alive. She is the one who wants to claim the pension. So Far we haven't approached the pension authorities. 

I would be so thankful to anyone who can give me the contact number to talk to a good lawyer who would have some understanding of this case and help my mother claim this pension.

You have option to claim pension.

For more details disclose all pension related documents.

Such as- Pension fill up form by your father.

Nominee details in said pension form.

Use RTI to collect these documentry evidence.
