Quazi said he will give permission for second marriage

I have few Questions please clarify

As per Muslim Personal Law

1.      When 498 A case is pending he/she eligible for second marriage?

2.      He is eligible for second marriage being a Government Servant?

3.      As Per Muslim Law with out First Wife Consent, He may eligible for Second Marriage?

4.      At present what legal action is correct against him?

1.      When 498 A case is pending he/she eligible for second marriage?

A. He is eligible for second marr not she, if talaq has happened then she has to wait till iddat period is over thn she can remarry but the 498a case wud go on.

2. As Per Muslim Law with out First Wife Consent, He may eligible for Second Marriage?

A. This law is no where in sharya, though some countries made it mandatory to take permission. U are remarrying fr a valid reason, no body is permitted to remarry jus for means of s*xual satisfaction.

4.      At present what legal action is correct against him?

A. All cases can be filed against him by her wife.

First get talaq thn think about marrying. There are many supreme court ruling as well as muslim law that husband has to maintain both wife equally.

But be prepared cases might be filed by your wife sooner or later. Collect enough proof before divorcing.
Irrivocable Triple talaq is valid if the wife is absconding and there r no means to contact her.
