Purchasing sra flat

Hello all, I am looking to Purchase SRA flat of 2 year old building from owner and also builder is offering some vacant flat in same building of SRA. Building location is in thane. Can any one help me with what type of documents required and if any issue for future in both the above scenario Ravindra.

Are you buying two flats, one from the owner and the second from the builder?  If you purchase two flats from the above two individuals, you shall get two sale documents from each person. You consult a local lawyer who will draft documents or a Document Writer. Before purchasing, obtain all necessary previous documents, including the mother document, EC and legal opinion

Since you’re looking at a 2-year old SRA flat at Thane, you need to be very cautious. Generally, SRA flats cannot be sold, transferred or mortgaged for 10 years (from the date of allotment/possession), except with special permission of the Collector/SRA. If someone is offering you a 2-year old flat for purchase, it is likely illegal unless it has already crossed the 10-year lock-in or has government permission.
If it is only 2 years old, resale is almost certainly illegal without Collector/SRA permission.
Any sale deed registered in violation of SRA rules can be declared null and void.
You may end up losing both the money and the flat if you proceed without proper clearance.
Banks usually do not give loans for such resale flats before 10 years.
