Punishment for Rape under section 376 IPC shall be punished with not less than 7 years but which may be for life or for a term which may extend to ten years. Question is under what kind of rape punishment can be for life or for a term extending to ten years, as Rape is Rape.So why this difference in the offence of Rape in punishment?

it all depends on facts and circumstances of case. it also gives ample discretion to the judge awrding the sentence.

yes, rape is one of most heinous crime. once legislature was contemplating death penalty. but as it involves the most human basic instinct it is not punished like similar other grave crimes.
