According to US law if a work was published before 1923, or first published in the U.S. from 1923-1963 without copyright renewal, it is almost certain to be public domain. As I understand in India it is 60 years after the death of copyright owner. My question is if I want to commercially use a very old artwork which is a public domain artwork in USA what are the implications ? As an example if I want to digitally reproduce a artwork from 1885 and sell it in my online platform. The painting itself is in public domain and the digital copy has been procured with commercial license also. Does anything in Indian copyright act prevent me to do this business ?
