Property Registration

Hello My father purchased a property in 1985 from his uncle (mother's brother) which is in name of uncle's wife and paid the amount but has not registered Now both his uncle and his wife are dead Childrens of uncle are not willing to register the property in my father name thus making excuses... We have Original papers with us Is there any possibility of getting the property registered without involvement of uncle children.

You have not mentioned whether it is Agricultural land or Non Agricultural Land, Flat, Plot, House etc.  Law is different for Agricultural property and Non Agrl. proper;ty. Kindly clarify the above doubt.

You can file specific performance case by paying the balance sale consideration amount.  If the legal heirs (uncles children) comes forward and register the sale deed then there is no problem.  If they wont come forward for registration, you pay the balance consideration to the court, the court will come to the registeration office and register the same in your favour.  Untill the registration is done, you do not vacate the possesssion.  If somebody occupies the possession, you case will become weak.

@Ravinder2345 Sir we dont have anything balance to pay them..what ever the amount it was we had paid in full. Will that make any problem if we approach court for help coz electricity meter, water meter and also muncipal are all in there name. Except we have original document and in possession.

If you have already paid the amount, it is much better. You just have to bear registration charges.  Buy paying charges of water, electricity, municipal tax, they will not any title.  If you have any further clarifications, contact to my mail.
