Property purchase

Hello All,

My father has purchased a Flat and paid the initial deposit of Rs.5 lakhs and told the dealer that the remaining amount will be paid at the time of registry. But later on we came to know that the property is at the name of a dead person and now his wife like to sell the property. As per court laws the kids have right in the property and she can't sell the property till the kids are major. Also she has sold the property to someone else before finalizing the deal.  Now we are asking for the refund of Rs. 5 Lakhs as it was agreed that if the registry is not done with in time frame the deal is cancelled and also we are not able to pay the balance in the agreed time frame then also the deal will be cancelled and 5 lakhs will not be refunded. The lady told that she will return the money in future.

The question is what legel help we will take as we are not sure whether we will get our money back and how long this judicial process will take place?

what is the terms and conditions?

Issue legal notice for recovery of money.

do you have hold any proof for payment of five lakhs. any forfeiture clause added
