Property partition law

Dear Sir,

Myself and my younger brother has got our parents property. We have done all the mutation procedure. Property is located in Calcutta, WB. We are now 50:50 property owner. Now we have a differces on the property. I have offer to sell my 50% share to my younger brother and he has declined. Now I want to sell my 50% to market buyer. Before that I have to do a partition suit as mutual partition agreement is not possible. How should I proceed?

File a partition suit on your brother.

if you cant work out a family partition among you both then you need to file a partition suit in the court to claim your share.before going for partition case obtain an injunction over a brother to prevent him from selling the property.contact a lawyer and he will help you to file the partition case.

You can file partition suit at your earliest and also get injunction order from courts for saving your property from your brother.
