Problems in taking possession of flat

Hi

I have booked a flat in G. Noida & facing below issues. Request the experts to guide me on this..

1. Issue between Bank and Builder: We have received offer of possession letter from the builder according to which we have to clear all the dues in two months time. In order to clear the dues, I have to give my final installment but the bank from which I had taken loan, has refused to issue the cheque. The bank is saying that there are some issues with the builder and till they sort them, the cheque wont be issued. Now, in the offer for possession letter, it was mentioned that if we dont clear the dues in 2 months, the builder will charge 18% interest. My query if the cheque gets delayed due to this issue between Bank and Builder, am I still liable to pay this interest?

2. Delay Payment charges:- Builder is asking for delay payment charges from all the consumers but the point is that the date of generation of demand letter is of later than the due date for eg if the due date to clear the payment is mentioned as 17 Feb, the generation date of letter is 20 Feb. The builder is now calculating the delay charges from 17 Feb.

3. Builder is asking for Rs 25000 for dual meter charges which was never disclosed earlier.

4. Builder is asking for 12 post dated & 12 current cheques on name of maintenance charges. This was also never disclosed earlier.

5. As per builder, once i will clear all the dues, within 02 months, he will give me possession of my flat but i need to know if flat is not as per commitment of builder or there are issues of like painting issue, leakage etc how would i pressurize builder to get it done. Do i have right to refuse to take possessions on any terms?
