Problem with notice period

Hi. I joined a company XYZ on december 1 2015 and I have signed a bond for 3 years and now I have got admitted in Canadian university and i want to pursue my further studies. So I need to join my university on jan 2 2017 and I have resigned on 12 October 2016. I can serve a notice period of 2 months but my company says that I have to serve for 3 months notice period.which is not possible in my case. They are intimidating me saying that they would initiate legal action if i dont serve 3 months notice period. Please give me advice as how to approach this situation. Thank you

While posting such queries employee should always post basic information;



What is this establishment; Commercial, Industrial?

What is its line of business?

How many persons are employed in it?

Does standing order apply in your case; Model/Standing?



What is your designation and nature of duties?

Do you have any power to sanction (Not just recommend) leave/increment/appoint/terminate/appraise/grant OT etc etc…………..



Can anyone change/cancel your recommendations?



How many persons report to you?



You are in which state?

Your service is under probation or confirmed?



For how many months you have been working?



What is the notice period tendered by you?



What is the notice period as per appointment letter?

Has your (notice of) resignation been accepted?



Have you been getting salary slips?



What was your monthly salary?

Has the employer communicated declinature in writing?

The said bond  was drafted in lieu of what extra ordinary benefits to you; say some certified training from certified Instt?

@ Kumar Many thanks for your reply. No, he just said orally that he would help in relieving me if I am going for further studies. No written proof. No, he has not given any training to me. I joined the company on December 1 2015 and on December 16 2015 I got selected and started working at the client's place. Since I have joined the company I have generated revenue to him. Moreover, because of my great performance at client's place I have been awarded as best performer award. Thank you
