Power of attorney

Hi Guys, I need clarfication on this: My brother, an NRI, had his FIL as his Power of Attorney. Now that FIL is dead, the POA has also become null and void. My question is whether my brother had to be present to execute another POA, favouring his MIL? Would like to know the procedure involved also. Thanks in advance.
