Power of attorney

What is the procedure for cancellation of registered power of attorney. If both the parties agree to cancel. Please tell me by steps. There is no clause. Could someone tell me the process to revoke POWER OF ATTORNEY.

Hello,

Draft a deed of Revocation of the PoA.

A notice of revocation of the PoA should be put in a local or national newspaper such that persons with whom the PoA has been interacting with on behalf of the authorising person is informed about the revocation.

The Cancellation deed will have to be registered by the same authority who registered the PoA.

A copy of the same has to be sent to the PoA such that he/she is informed about the same.

Copies of the revocation deed can also be sent to persons with whom the PoA holder has been interacting with on behalf of the principal such that they cease any business dealings with the agent.

1. IF POA maker and POA holder, both wish to Cancel /Revoke the POA, THEN both of them can mutually execute a "Revocation Document" and have it registered ANYWHERE in India.

2. AFTER above, the POA holder becomes irrevocably & legally bound and CANNOT represent as POA holder for any purposes.  There is no need for any News Paper Notice or any Individual Notice to anybody else.

A cancellation deed may be registered by the executant and intimation be given to attorney.
