Power of Attorney

I am in USA. I want to give POA to a person in India to buy a property on my behalf. Please let me know the procedure...

you prepare power of attoerney form USA AND GET it  registered and  sent to india for adjudication . and  u r attoerney will  do needful in india.

The POA as per your intentions has to be drafted and notarised in USA by the competent authority and sent ot India.  It will reported to local ffice as aan adjudication, they make collect stamp duty as applicable in India.  Once adjudicated, you can use the POA.

Is there any POA form that I can download and use it? I think i have to get an attestation from the Indian Counsulate here and send it to India to get adjudicated. Is my understanding right?

YE AND THESE PRESENTS, I, XXXX, S/o. D/o.W/o. XXXX, HIndu, aged years,
residing at XXXXXXX, execute this Power of Attorney on this the    day of November, 2008 at XXXXXX, XXXXXX.


 


In favour of and appointing


 


Sri XXXX S/oXXXXX, Hindu, aged XX years, residing at XXXXXXXXXX as my Power of Attorney.


 


Whereas
my father XXXXXXXXX had inherited a house property/ I purchased a house
property, bearing Municipal No. XX, situated at XXXXX, XXXXX, XXXXX.,
from his father XXXXXXXXX/ Seller, and whereas my father died on
XXXXXX, intestate leaving behind myself, my brother and sisters as
surviving legal heirs for his estate/ to invest the sale proceeds in a
better way I have decided to the sell away the house property.


 


Whereas
all of us jointly decided to sell away the house property so that the
proceeds realized can be used for better purpose. That as I am residing
at XXXXXXXXX and due to exigencies of my personal works I cannot attend
in person for registration and such other purposes hence I thought it
fit and proper to appoint Sri XXXXXXXXX, who is my brother and also
holding a share in the house property to act on my behalf and dispose
of the property and to do the following acts or things that are to say:


 


01. To
negotiate, sell and execute sale deed and other documents with respect
of my share in house bearing municipal No. XXX situated in XXXXXXX to
any prospective buyer after negotiating for such sale consideration,
which is just, proper and equitable as per the discretion of my
attorney.


02.  To receive from the buyer the sale consideration either in part as advance or in total and issue proper receipt to that effect.


03. To execute a sale deed of the said property in favour of the said buyer on my behalf.


04. To
present the said sale deed for registration, to admit the receipt of
consideration before the registering authority to have the said sale
deed registered and to do all deeds and acts necessary for conveying my
share in the said house property to the buyer.


05. To
declare the value of property before the registering authority and also
to sign necessary forms for the purpose of completion of registration.


06. To
appear before any Court or Authority for the purposes of any matter
relating to the registration, declaration of value or any other
proceedings connected with the same.


07. To
engage advocate or authorised representatives to act on his behalf in
the said proceedings to do all other acts that may be necessary for the
proper completion of the work assigned by me to my attorney under these
presents.


08. I
do hereby agree and declare that all acts, deeds and things done,
executed or performed by the said attorney Sri XXXXXXXXXXX, shall be
valid and binding on me to all intents and purposed as if done by me
personally which I undertake to ratify and confirm whenever required.
