Hi Sir,

My wife left me 2 years back and not coming to me . If i sak her to come to me , she is saying that she will clear all her parents loans and then she will return. she is saying she will give 20% of her salary every month until they die. She is saying that i need to accept all this conditions then only she will come to me.

I got angry on her for her selfish reaons and posted in face book about this conversations and her demands in facebook account on my walland shared to friends.

But in facebook i did not mension her parents names. i just mension the conversation so that every one know her and her parents character.

But Now she is saying that she will file Criminal case on me by doing so. ?

Please advice is that a crime. i have all the proofs about conversation and i did not mension any one name on fb post.

Is she the only child to her parents.if so she is doing no wrong.even if she has brothers and sisters to an extent she can share and repay the loan.just sit and talk with her and arrive at a solution.

Her stand appears to be quite reasonable, and she has right to proceed against you for tarnishing  the image of ,and defaming,  her parents by posting in the FB.

Her tip of position seems reasonable. Sit and talk to her & find the solution.

I am rather surprised to hear that, you posted your private conversations with your spouse, on FB post.

There many choices available to her for the proceeding against you.

Without getting into moral merits of the case, and confining only to your query, she can file a criminal case under criminal defamation and I T  act, will she get desired results, is a million dollar question? So do not worry carry on with your work, but desist from posting such msgs in future, it may be counterproductive.

Will she receive DESIRED result or not, is not so important. Accused have to squander time, effort & hard earned money by involving into a judicial proceeding, prior to see the outcome at least.

so your anger is that she is financially supporting parents which you do not want.

you want her entire salary without she having any discretion to spend the way she likes?

without agreeing so you will not live with her?

is this the condition for continuation of married life?

She is entitled to support her parents (even 100%) of her salary if she desires and still you  have to keep her.

She appers to be gentle enought in not troubling you with legal hassels and past two years could have been sufficient for her to make hell of your life.

in order to provoke her to go to police you posted remarks on facebook?

now comments on FB

the actual contents of the comment are not there before this forum.

But if these are defamatory or injurious in any other manner then criminal case is on cards.

She may file case for defamation as per limited information/inputs given by you.

Sudhir Kumar, Advocate (Advocate)     01 May 2016

I am no able to agree or disagree whether defamation is/is not tenable.  it may be other crimes.

apparently you are yet to spoil your life fully you seems to be having still a time to "U" turn and save further peril.

Your own limited nformation indicates that you and you are wrong.
