possession of flat

actually we are three family members and out these one family memeber has transfered his share to other family member with gift deed...and we have not taken possession of flat....my doubt is builder noc is required or not for doing gift deed...and if it is needed should I disclose the gift deed to builder after taking possession or before the possession...please help

Why builder NOC for gift deed. Procuring a (NOC) from the society that includes your apartment or the builder from who you are purchasing the apartment is essential. Obtaining a NOC ensures that there are no dues on the property by the seller at the time of selling the property.

Builder is not related to share of either of the shareholders.

However, facts posted are not very clear to form proper opinion and oblige.
