Political affiliation of Trade Unions

Can a Company prohibit its workers (labourers) from affiliating their Trade (Workers') Union with a Political Party?

As per Article 19(1)(c) it is Fundamental Right of citizens to form associations or unions. A Company and Union are two seperate entities. How can a Company dictate to a Union as to how it will conduct its relations with a 3rd entity i.e. political parties? If a Company is allowed to do such things, the very purpose of forming Union(Fundamental Right) gets defeated.

There is no legal provision for a company to prohibit the Union of workmen from affiliating their Union with a political party.

Trade Unions Act specifically empowers the concerned State to approve the federations of Unions, These federation have their own political ideologies. Thus a legal forced has been already been provided to these federations affiliating the Union having same ideology. Moreover, our Constitution also provide such mandate by including it in fundamental rights. Thus there is no illegality in having affiliation of an union to a particular political party.

The situation will be different if the Company is Govt company.
