Police refusing information under rti

Dear Experts,

Can the police investigating officer refuse to give copies of statements of complainants, witnesses etc. citing reason of pending investigation under RTI?

Are there any orders of the CIC which instruct the police to share the information?

It is a false case filed under 498a and 506.

No you can not have charge-sheet through RTI. It is the statutory duty of IO to submit the charge-sheet only before the trial court.

 

  • Accuse will get a summons and the copy of the charge sheet free of cost.

 

 

  • Apart from that one can apply for the certified copy from the court.

Police cannot give you such details under RTI. However, you have right to get all this information from court. Court will provide you all this information once challan is sent to court. It takes a long time for all this process. Be patient. You will be allowed to study all the cards of prosecution before you have to utter a single word in your defense.
