Transfer petition... and the respondented did not apprear on the hearing.... wht does this mean..... ? pls explain

O R D E R
Await return of notice of the sole respondent.
List the matter on 10.7.2013.

1. The Registry did not file Service Report hence such Order cometh.
2. Service the Notice again in 15 days to respondent so that he can make appearance on NDOH.
3. If respondent / his side pleader does not file appearance on NDOH it will be assumed deemed Service and a 'just' Order on transfer will proceed in accordance with Law.
[TP's are summary proceedings I am slightly surprised ld. Court is awaiting Service upon respondent but nevertheless glad to know context Order’s is based on ‘equity’ principles may be it is some Crl. matter TP!]
