Hi Sir,
My brother death Pf claim regards please help with legal point.
My brother is divorced and his Pf nominee was his mother. Unfortunately his mother passed away last week and she already given Letter of Authorization to me before her death.
Can u help me on how to move forward .
This discussion addresses a complex PF death claim where the original nominee (the mother) has also passed away. The claimant has a letter of authorisation from the mother but is advised that this alone may not be sufficient. To proceed, the claimant will likely need to obtain a succession certificate in addition to the death certificates of both the brother and mother, and submit these with a formal application to the PF office.
As per your situation, you need to have proper documentations which should include the death certificate of your brother, his mother being nominee of the provident fund claim and a letter of authorization which was later on granted to you resulting in making you the next nominee after her death.
These documents along with an application (stating the stages of all the situation/scenarios related to pf) should be submitted to the pf office, after which they may process the requisite amount withing some time (which might take 3 months duration).
