petition for family pension

petitioner husband died, who is government employee, she applied for pension as legal hire but government didn't give
family pension.
she wants to move case against concerned Department. where should she file case and under which section of law?
district court, or labour court? please answer my question

Hi! Thanks for the question!

Here it is important to know on what grounds have your claim been denied? Here you will have to disclose the reason that the department has furnished. If your name is recorded in the service book, then the department cannot deny the pension and other benefits whatsoever from being transferred to you and the pension is transferred in a matter of few days.

If there is no sufficient grounds for the same, you can move the Service Tribunal as well as the Civil Court having competent jurisdiction and you may even find the High Court to your aid.

The section and provisions of laws will depend upon the grounds of denial and can be certained only when you furnish full details.
