personal leave availement in same calander year

can any one suggest me about the personal leave policies in a private limited company.

whether the earned leave can be availed in same financial year or not as per factory act.

In a private limited company, the h.r norms differ from organisation to organisation.As some companies allow an individual to carry forward their leave balance while in some, leaves lapses at the end of the year. So there is no standard norms fixed in a private firm. You will have to go through your H.R manual for the same as it is one of the guidelines applicable to all the employees on a uniform basis

As per the provisions of the FactoriesAct, the  leave  earned during the  calendar  is to be enjoyed in the subsequent calendar year. Besides, the leave can also be carried forward. Therefore it is not necessary that the same should be enjoyed in the same financial year. The leave policy has to be based on the provisions of Factories Act.However, if the leave granted  is exceeding than that provided in the Factories Act ,  the Company can frame its own leave rules, which may differ from Company to company.

Mr. Lad has responded with sufficient details. I Would like to add that the leave rules depends on whether the company has establishments under the shops and establishments act (commercial establishment), factories act and also  the standing orders appplies to the company. General rule is that the leave can be carried forward to the next year. The accumulation is as per the policy of the company, framed in accordance with the applicable law (any one of the above as may be applicable to the particular establishment)

Under Facories Act, 1948 the leave can be carry forwarded to tne next year. You have to refer the standing orders of the institution also, if there is one.
