Person not heard since the last 8 years

Person Not Heard since the Last 8 Years            

 

Sir,

My Client is having a Joint ownership house with his father since the last 9 years. The situation is that his father is missing since the last 8 years. A Police Complaint has been filed at that point of time. However the police are unable to trace them.

Now the situation is as per law if a person is not traceable since the last 7 years he is presumed dead.

Now he wants to change the Joint name of the flat in his own single name.

Pls let me know the procedure what is to be done in this case.

Should I first contact the Police get their statement, get the Death Certificate from the Municipality And get the name changed on the Share Certificate from the Soceity Committee or is it some other way.

Since you have reported the matter to the police, a report from the police is required that his whereabout is not know for the last these years and have been unheard of from any quarter is the first procedure, then you can go for other procedure. The municipality authority will not grant you death certificate only on your oral version.
