AN APPEAL TO ALL RESPECTED LAWYERS:
Why do one take the advantage of this loophole in our law. Out of 10 cases reaching courts today for perputual injunction order 9 are false cases filed by tenant and they just keep harassing the owner spoiling the mental peace.
Why not we in this modern era come out of this taking advantage of loopholes. It has become so easy for any tenant to just go to a lawyer and give him some proof that he is residing there and can get injunction order immediately. Dear Mr.Lawyers understand the pain of the owner in this situtation. He has provided shelter to tenant so long, he has invested his sweat and blood in building this property and for that in return the tenant makes him to run around the courts taking away his an his family members mental peace. And in these cases most of the time tenant does not pay the market rent value.
Why not law be strict in these cases. Why they give so easily injunction orders and cases runs for years and then again the owner can evict the tenant through the lenghty process of eviction. In the bargain the tenant has nothing to loose. He enjoys time for years and pays the same old rent and after years even if the owner wins the case the tenant just walks out. In case of false tenants ( Most of the time false tenants only file this injuction order) why not the law be strict? If the tenant is proven to be on wrong side why not they given a penality of paying double or triple the rent for all the time lost by the owner? This will atleast make the tenant think twice in moving this step.
Why does our courts run these cases for years? Some Lawyers just keep postponing the cases by taking time for some reason or the other!! Just think once my dear lawyers even though it is profession is it right to do this? Do you dont believe in Gods court where everyone of us has to answer? If professionally this is correct then a theif who does theft is also correct since he is doing his profession why do we punish him?
Please understand me. My intentions are not to hurt any lawyers. I want to request or plead the lawyers to tell their clients in the first instant that what they are doing might be wrong if they smell there is a foul play by tenant. Please take up cases only if you feel it is justified. Afterall you are the first judge in the justice and then comes court and then judges. Money can be earned in many ways. You cannot hire a servant maid without her will as long as you can. You cannot hire a car without the will of the travel agency as long as you can. You cannot hire an employee without his will as long as you can. You cannot work in a company as long as you can if the company does not want you.... !! BUT YOU CAN HIRE A HOUSE AS LONG AS YOU CAN WITHOUT THE INTEREST OF OWNER !!!!!!!!!!!!!!!!!! THIS IS LAW.
