Payment of gratuity act, 1972

If a company hires the same employee as consultant again after leaving the office, will he receive gratuity again ?

Quick Summary
This discussion clarifies whether an individual re-hired as a consultant after leaving a company is eligible for gratuity again under the Payment of Gratuity Act, 1972. The consensus is that a consultant is not considered an employee. Therefore, once an individual is no longer on the company's payroll, they cannot claim gratuity for subsequent consultancy work.

A consultant is not the employee of the company.

Once he has been terminated from the rolls of the company he is no more an employee of the company hence he cannot claim gratuity again.
