PARTITION OF ANCESTRAL PROPERTY

 

Respected Sir,

              My name is Sebastian and we are Christians settled in Navi Mumbai.Originally we hail from Thrissur,Kerala .This is about the ancestor property we have in Kerala.My Uncle(Elder brother) had acquired the ancestor property of about 50 cents land and a big old house in it through a assigned deed from my grandfather for Rs500/.He expired (inestate) in 1990 and his wife(my aunty) used to live in that house but, now she stays with her brother for the last 3 years because she has mouth cancer.Now,my aunty has written a will that after her death her share of the property should go to her brother's son who is taking care of her in their house. Now,My father(middle brother) has expired in 1996.I have an uncle(youngest uncle) and an aunty(3rd sister) who is surviving solely and also 2 cousin sister's(2nd sister children) and 1 cousin brother,2cousin sister's(4th sister's children). 

             Now after my Aunty's death can we get a share from our ancestor property and how will this property be partitioned.

sorry bt ur query is not clear...

if ur grandfather sold the property to ur uncle, thn u cant claim anything. further all the property belongs to ur uncle and after the death of ur uncle ur aunt became the sole owner of the property, she can defently will out the property... there is no question of ur share !!!!
