parked vehicle charge sheeted

A running vehicle (lorry) hit from its back of a parked lorry in a high way. The subject vehicle has no insurance in force. Our Indian Police, with their scottish knowledge for quid pro quo, charge sheeted both the lorries and the court had awarded against the parked lorry so as to facilitate to perforate the insurance company.

I am the responsible officer to defend the case hence, shall be obliged to get assistance if case law from SC/HC is available -regards vaidya
