Order 1 rule 10

 Regarding   relief against necessary  party  ,please  try to  digest  the  concept  of  joinder of necessary  parties , or you may  please   wait  so as to enable me to   convince you  with some   decision

The court has jurisdiction to add  necessary parties  suo motu, please gothrough  order 1rule 10(2)  of  CPC , if the  trial  court  can  do it ,it  can be  done even by appeallate court.  but  subject to  Limitation  as  opined by me  earlier. but I  have come  across a  decision  wherein  necessary party was  added  even   after  limitation ha  expired!
